Probationer gets 2 years for loan-modification case

SAN DIEGO — A man who had been on probation stemming from an attack on a local television reporter in 2006, was sentenced Monday to two years in prison for failing to adequately provide the loan modification services he promised through his business.

Assad “Sam” Suleiman, 41, pleaded guilty in October to violating a portion of the California civil code regarding mortgage foreclosure consultants. He also admitted violating probation on the 2006 case in which he was caught on camera assaulting then-Fox 6 News reporter John Mattes.

Citing the defendant’s previous legal troubles, San Diego Superior Court Judge Kenneth So said Monday that Suleiman was not a good candidate for probation.

“You’ve had several opportunities with the criminal justice system to succeed and you haven’t taken advantage of them,” So said.

The judge ordered Suleiman to pay restitution to the victims, an amount to be determined later. That amount may be as high as $11,000.

Because he has credits for time already served in jail, Suleiman isn’t likely to spend much more time behind bars. His lawyer, Kerry Steigerwalt, estimated that Suleiman would probably serve another 45 days.

Suleiman’s former wife, Rosa Barraza, pleaded guilty in October to a violation of the same mortgage foreclosure consultant law, which was reduced to a misdemeanor. She was placed on probation.

Barraza once worked at Kerry Steigerwalt’s Pacific Law Center, which the attorney announced in late June would stop taking new clients. The website for the embattled firm, which has been dogged by lawsuits and client complaints, now says it sees clients only by appointment.

Steigerwalt said Monday that Barraza’s recent case had nothing to do with her work “processing paperwork” at his firm.

According to court documents, Suleiman owned and operated a business called Loan Modifications Inc. through which he purported to help customers who might be behind in their loan payments to deal with their lenders. He had offices in San Diego and La Mesa.

Prosecutors contended that some customers paid thousands of dollars to Suleiman, but still lost their homes. Some asked for refunds but did not get their money back.

During the Monday hearing, Steigerwalt argued that his client tried to help the all of the customers who came to his business, but was unsuccessful.

“It wasn’t a scheme or a scam,” Steigerwalt said. “The loan modification is difficult at best. It doesn’t mean he didn’t work on these loans.”

Suleiman told the judge he had learned some lessons and did not expect to return to court in the future as a defendant. Instead, he said, he was preparing to apply to law school and wanted to “serve the community and become a good attorney.”

He told the judge he didn't think he could get into law school with a prison record.

After pleading guilty to assault in 2007, Suleiman was sentenced to a year in county jail and placed on probation for three years. According to testimony from that case, Suleiman punched, bit and kicked Mattes, who had been interviewing a man who lived next door to a commercial building in La Jolla that Suleiman owned.

The reporter was investigating allegations of a real estate scam involving Suleiman and Barraza.

It's official: Jeffrey Phillips, the flashy frontman for the Phillips and Associates personal injury law firm, will not be allowed to practice law for six months thanks to a decision handed down today by the Arizona State Supreme Court.

Following a lengthy investigation last year by the Arizona State Bar Association, it was determined that Phillips failed to supervise his employees well enough to comply with Arizona Rules of Professional Conduct.

Basically, it was found that some of Phillips' clients handed over cash deposits before ever speaking with a qualified attorney. Rather, the investigation determined, clients often were misled into ponying up deposits by office salesmen working on commission.

After the investigation, the Disciplinary Commission of the Supreme Court handed down a
recommendation to suspend Phillips and his "associate" Robert Arentz for six months and one day, followed by two years of probation.

Arentz ultimately served a 60-day suspension and has since been reinstated.

Although the court reduced his suspension by only one day, it's good news for Phillips.

If the suspension had held at six months and one day, Phillips would have had to re-apply with the state bar to resume practice. By dropping the extra day, Phillips will not have to re-apply.

Last year, Phillips told New Times he was disappointed but not surprised by the recommendation from the Disciplinary Commission and that the initial complaint, filed with the State Bar Association back in 2002, was the result of some dissatisfied clients.

"In a two-or-three-year period, our firm handled about 33,000 cases, and only 21 people had a problem with how we represented them," Phillips says. "You just don't win every case, and people get upset about that."

Phillips says some of the 21 clients even wanted their money back, and in most cases, his firm was happy to hand it over. 

Phillips and Arentz could have received a recommendation for disbarment but the commission felt that the six-month suspensions would be more appropriate.

Attorney Jeffrey Phillips has taken steps to maintain the name of his law firm, Phillips and Associates, after the Arizona Supreme Court ordered that he can't be mentioned in advertisements or letterhead during his six-month suspension.

R. Glenn Phillips, a Washington attorney who appears in television ads with Jeffrey Phillips, filed Articles of Incorporation Dec. 8 for Phillips Law Group, whose address and telephone number listed on the documents is the same as Phillips and Associates.

Rick DeBruhl, spokesman for the State Bar of Arizona, said the bar will be keeping a close eye on the situation.

"Our goal is to make sure it isn't something that is going to mislead the public," DeBruhl said.

The Arizona Supreme Court suspended Jeffrey Phillips Dec. 16 for six months after a disciplinary commission found he committed ethical violations. Jeffrey Phillips was also penalized in 2002 for similar violations.

The State Bar asked for a suspension of six months and a day, which would have effectively taken him out of the practice of law for two years because lawyers who are suspended more than six months must go through a prolonged reinstatement.

Jeffrey Phillips has become a fixture on local television pitching his firm and one of the questions while his ethical case was pending was whether he would have to close shop because suspended lawyers are required to take their name down so as not to mislead anyone they are practicing law.
